Terms and conditions
1. Partnership
Our absolute priority is to ensure that you are satisfied with our products and services. Hence, our general terms and conditions (GTC) constitute the basis for fair and lasting partnerships. By placing your order, you accept these GTC.
2. Orders
Orders can be placed on our website www.bauraulacvins.ch, by phone +41 44 777 05 05, by
fax +41 44 777 05 03 or by e-mail to bestellungen@balv.ch. Alternatively, you can drop in on us, as it is always a privilege to advise you personally in our Baur au Lac Vins shops. NB : online orders for recipients abroad (outside Switzerland and the Principality of Liechtenstein) cannot be completely and correctly entered via our website until further notice. We reserve the right to offer certain wines (e.g. rarities) in limited quantities and/or only on the Swiss market.
3. Offers and contract conclusions in our webshop
Presentations of products in the www.bauraulacvins.ch webshop do not represent legally binding offers, but rather invitations to customers to place orders that are binding for them (offer to conclude a contract). By clicking on the order button, the customer places a binding order for one or more products listed on the order page. Immediately after receiving the order, Baur au Lac Vins will confirm receipt of the order by e-mail. The contract of sale is only then concluded when Baur au Lac Vins confirms dispatch of the goods by e-mail (order or dispatch confirmation) or, at the latest, when the goods are delivered. In the case of advance payment, the purchase contract is concluded upon confirmation of receipt of that advance payment.
4. Protection of minors
Throughout Switzerland and Europe, it is legally prohibited to sell alcoholic beverages to children under 16 years of age. Tobacco and spirits cannot be sold to minors below 18 years of age. By ordering from Baur au Lac Vins, you agree to these regulations and confirm that you are legally entitled to buy such products.
5. Prices
Prices are quoted in Swiss francs (CHF) inclusive of 7.7 % VAT for private and corporate clients. The prices for gastronomy and specialist retailers are exclusive of 7.7 % VAT. We reserve the right to adjust prices and make changes to our product range and terms of delivery. Export shipments are invoiced free of VAT.
6. Discounts
6.1. Discount on merchandise value
Contribute to protect our environment. We offer attractive discounts on bulk orders/deliveries (single destination) such as:
- 2 % on CHF 2,000.00 or more
- 3 % on CHF 3,000.00 or more
- 4 % on CHF 4,000.00 or more
- 5 % on CHF 5,000.00
6.2. Discount on customer collections
2 % on customer collections from Baur au Lac Vins in Regensdorf
7. Right to replacements, returns and food safety
7.1. General / Product categories
We request buyers to check the condition of received goods immediately upon receipt. Buyers have the right to return wines of the categories (or product groups) 20, 30, 40 and 50 (designated «Assortment Baur au Lac Vins» or «Exclusivity Baur au Lac Vins») to the point of sale (shop or, in the case of webshop orders, to Baur au Lac Vins, Adlikerstrasse 272, CH-8105 Regensdorf) within 14 days after delivery without stating reasons. Costs incurred for return shipments are to be borne by the buyer. Provided the returned goods are in perfect condition, already paid purchases will be refunded or credited to the customer.
Excluded from this procedure are:
- Category 10 (product group) wines (designated «Limited/Rarity»)
- Wines not purchased from Baur au Lac Vins
- Delicacies, food, gift baskets
7.2. Defective wines
Wines that are opened after the abovementioned 14 days and prove to be defective (e.g. cork taint) can only be replaced by equivalent wines as follows:
- exclusively those from the categories (or product groups) 20, 30, 40 and 50 (designated «Assortment Baur au Lac Vins» or «Exclusivity Baur au Lac Vins»)
- within reasonable limits, i.e. up to a maximum of 1% of the original bottlings purchased and within a maximum of 18 months after delivery.
7.3. Rarities and limited wines
Under no circumstances can these wines, assigned to category (product group) 10 and (designated «Limited/Rarity»), be returned. They are sold as «Buyer’s risk», whereby the risk of a potential defect, such as cork taint, is borne by the buyer.
7.4. Food safety
If we discover or have reason to believe that foodstuffs or commodities imported, manufactured, processed, treated, dispensed or distributed by us have endangered or are endangering the health of consumers, we shall immediately take the necessary measures, inform the competent cantonal enforcement authorities if necessary and recall the products (Art. 84 LGV, Lebensmittel- und Gebrauchsgegenständeverordnung (Foodstuffs and Commodities Ordinance)).
8. Terms of payment
8.1. Deliveries within Switzerland and the Principality of Liechtenstein
Payment net within 30 days from date of invoice. Deductions are not accepted. We reserve the right to deliver to customers unknown to us against advance payment. All goods remain our property until paid for in full. Baur au Lac Vins is authorised at any time to register its reservation of title with the competent authorities.
8.2 Default interest and reminder fees
If payment is not made within 30 days, the customer is in default and will receive a written reminder. With the reminder, the following charges will be due:
- 1st reminder after 14 days: CHF 10.00
- 2nd reminder after 28 days: CHF 20.00
- 3rd and last reminder after 42 days: CHF 20.00
In addition to the reminder fee, default interest will be charged at a rate of 5% as of the due date of the claim. Baur au Lac Vins reserves the right to collect the claim through a debt collection agency.
8.3. Deliveries abroad
Deliveries against payment in advance or by credit card only.
9. Terms of delivery
9.1. Deliveries within Switzerland and the Principality of Liechtenstein
Deliveries are carried out by postal service, by VinoLog, by carrier or Baur au Lac Vins vehicle. In the case of bulk deliveries, these are done free domicile as follows:
- for private and corporate clients: from 30 (75cl) bottles or CHF 200.00 market value or more
- for gastronomy clients: from 42 bottles or CHF 800.00 market value or more
- for specialist retailers: from 48 bottles or CHF 1,000.00 market value or more
For all other deliveries, the costs are borne by the buyer in accordance with the published cost overview in the current price list or at www.bauraulacvins.ch.
For subscriptions (e.g. Bordeaux, Burgundy) deliveries are charged at actual cost.
Returns are charged at cost and at the expense of the buyer. See also Art. 7.
Goods are transported at the customer’s risk. In the event of claims arising from loss, damage, leakage, etc. during transport, customers are requested to contact the transport company concerned (Post Office, VinoLog, forwarder or Baur au Lac Vins) direct.
9.2. Deliveries abroad
The goods are transported at the customer’s risk and for the customer’s account. Our sales staff will be happy to inform you about arrangements for shipments abroad and current rates; see also Art. 2.
10. Subscriptions
The published conditions for the respective subscriptions (e.g. Bordeaux subscription) apply, which may differ from the GTC (e.g. prices, discounts, transport costs).
11. Credit information
The buyer authorises Baur au Lac Vins to request information necessary for the execution of orders from public offices or a central service for creditworthiness rating. This clause applies only for orders against invoice.
12. Privacy policy
We trade in wines, spirits and gourmet food, but not in personal data. Consequently, only those data are collected that are necessary for processing orders and which simplify dealing with returning customers. Personal customer data are treated confidentially in accordance with data protection legislation and not passed on to third parties, nor are they used or sold for third-party advertising. Particularly sensitive data (especially credit card payment details) are transmitted in encrypted form for authorisation requests. Our customers can receive current information about news, promotions or activities via electronic newsletter. This service is free of charge and can be cancelled at any time. Baur au Lac Vins does not use digital addresses to generate SPAM advertising. See also

13. Web links
All internet sites that are linked in any manner to our www.bauraulacvins.ch domain were checked for content and form before linking. Whereas we access those linked sites regularly, we cannot exclude the possibility that content is published which is not directly related to our product range. In doubtful cases we would be appreciate a message to our webmaster. We firmly dissociate ourselves from all abusive content and do not assume any responsibility for the correctness and content of such linked pages.
14. Changes to the GTC
These GTC may be changed at any time without prior notice.
15. Jurisdiction
The business activities of Baur au Lac Vins operate exclusively under Swiss law. Place of jurisdiction is Zurich.
