Terms and conditions

1. Partnership

Our main objective is to give you satisfaction. Thus, our terms and conditions form the basis of an equitable long-term partnership. By ordering, you accept these terms and conditions.

2. Orders

You can find order forms in our price list “True Values”. Place your order by telephone on
+41 44 777 05 05, fax on +41 44 734 29 09 or email at bestellungen@bauraulacvins.ch. Or come in and see us: we will advise you personally at our Baur au Lacs Wines branches. You can see our complete range of wines at www.bauraulacvins.ch.

3. Protection of minors

By law in Switzerland and Europe, it is prohibited to sell alcoholic beverages to children under 16 years. Spirits can not be sold to minors under 18 years. By ordering from Baur au Lac Wines, you agree to these terms and confirm that you have the right to buy.

4. Prices

Prices are quoted in Swiss Francs inclusive of 7,7 % VAT (privat and corporate clients). We reserve the right to adjust prices and make changes to our range of products and the terms of delivery. This price list supersedes all previous editions. Overseas shipments are made free of VAT.

5. Discounts

5.1. Value discounts (on merchandise only):

Contribute to the protection of the environment. We offer attractive discounts on bulk shipments (to a single destination):

2% for CHF 2,000 or more
3% for CHF 3,000 or more
4% for CHF 4,000 or more
5% for CHF 5,000 or more

5.2. Discounts for customer collection

2% for customer collections, only at our Baur au Lacs Vins Regensdorf headquarters

6. Replacements/returns

We ask the buyer to check the condition of the received goods immediately after receipt. The delivery is considered accepted after eight days. Wines from our exclusive representation or from other specific wineries (see list below) which are corked or presenting other defects may only be replaced within reasonable limits, i.e. up to a maximum of 1% of the original bottlings purchased and within a maximum of 18 months after delivery. For rarities, Bordeaux and Burgundies, no substitutes can be granted. They are sold as "Buyer's risk". In these cases, the risk of a possible defect, such as corked wine, is borne by the buyer. Wines not purchased from us cannot be reimbursed.

7. Terms of payment

7.1. ... For deliveries in Switzerland and the Principality of Liechtenstein: net 30 days from date of invoice. Deductions are not accepted. Late payment and penalty interest will be debited immediately. We reserve the right to deliver to unknown customers against advance payment. The goods remain our property until paid for in full. Baur au Lac Wine is authorised at any time to register its reservation of title with the competent authority.

7.2. ... For deliveries abroad: payment in advance or by credit card only.

8 . Terms of delivery

8.1 . ... For deliveries in Switzerland and the Principality of Liechtenstein: deliveries are made by mail, by Vinolog, by carrier or by Baur au Lac Wines vehicle. Delivery is free for bulk shipments of 30 (75cl) bottles or CHF 500.00 market value or above (applies to privat and corporate clients), 42 (75 cl) bottles or CHF 800.00 market value or above (applies to gastronomy clients), 48 (75 cl) bottles or CHF 1’000.00 market value or above (applies to specialized retailers).

For all other shipments, the costs shall be borne by the buyer in accordance with the cost overview for delivery of gifts by mail and carrier and for packaging published in the current price list or at www.bauraulacvins.ch. In the case of subscriptions (e. g. Bordeaux, Burgundy) the delivery takes place at actual costs. The transport of goods is at the customer’s risk. In case of loss, damage, leakage, etc. during transport, the customer is asked to approach the transport company concerned (Post Office, Vinolog, carrier or Baur au Lac Wines) directly.

8.2 . ... For deliveries abroad: transported at the customer’s risk.

Our sales staff will be happy to inform you about arrangements for shipments abroad and their current prices.

9 . ‘En primeur’ orders

With the respective subscription (e. g. Bordeaux subscription) published conditions apply, which can deviate from the general terms and conditions (e. g. prices, discounts, transport costs).

10 . Credit information

The buyer authorises Baur au Lac Wines to request information necessary for the execution of an order (only for orders against invoice) from public services or a central service relating to his solvency.

11 . Privacy policy

We trade in wine, spirits and gourmet food but not in your personal data. That is why we do not collect or save anything more than absolutely necessary for your orders. Your personal data are processed in accordance with the laws on the protection of personal data and are not sold or given to third parties for any advertising. When requesting authorisation, in particular when paying by credit card, your bank details are only transmitted encrypted. Customers can learn about news, events, promotions and activities via our electronic newsletters. This service is free and can be cancelled at any time. Baur au Lac Wines does not use its contact lists for spam.

12 . Web links

All internet sites cited and created in connection with our www.bauraulacvins.ch domain have been checked in both their form and their content. Despite regular monitoring of connected networks we do not guarantee their content. In case of abuse please contact the webmaster. 13 . Changes in general terms

These terms may be changed at any time without notice.

14 . Jurisdiction

The business of Baur au Lac Wines is based exclusively on Swiss law. Its seat of jurisdiction is Zurich.
